Supreme Court fine with arresting a child for burping.

In what sounds like a piece out of the Onion, Reuters reported that the U.S. Supreme Court on Monday declined to revive a civil rights lawsuit against a New Mexico police officer for arresting a 13-year-old boy who burped repeatedly and disrupted his class.

The arresting officer, Arthur Acosta was granted qualified immunity and will be protected from any lawsuit.

According to Reuters, Justice Neil Gorsuch did not take part in considering whether to take up the case. Before joining the Supreme Court in April, Gorsuch was part of the three-judge federal appeals court panel in Colorado that previously ruled 2-1 in favor of Acosta. Gorsuch was the dissenter in that ruling, saying the boy should not have been arrested for intentionally belching.

In my day the principal would have just called his parents and said. "Your kid was acting like a little asshole in class today" and the little snot would have been taken care of at home.

Mine to. If I got a few swats with a paddle at school for being a little asshole I kept my mouth shut about it and just hoped the principal didn't call my dad. because THEN I'd really catch it.

Teachers these days are ludicrously constrained in the means available to them to discipline unruly students. Many parents these days do not react the way the above poster's and my parents would have reacted to such a thing.

So what options are there other than to call the cops if a kid is being a total shithead. None. Good for the teacher, good for the cop and good for the court.

Was the alleged burp a necessary biological function or purposely done to piss off the teacher? Back when I was in Junior High some students would swallow a quantity of air and purposely make a loud burp and some could use burping to talk which we kids thought hilarious. I make frog noises without opening my mouth but the teacher could not figure out who was doing it.

That is a frighteningly authoritarian POV. It is opinions like this that demonstrates why we must remove the state from the education system. Hopefully this is not the opinion of many Americans. I mean we know that our hat is the canary in the coal mine, but then again they want to give their schools the authority to give children gender reassignment therapy and they are making moves to have speach laws so I will take these opinions w/ a grain of salt.

Clara is a retired public elementary school teacher and Pensacola is a High School physics teacher. Ask them how they handle unruly students?

edit: I made a stupid but intelligent remark in Junior High School and the teacher put me down by saying, "You are bright and brighter than the Sun."
