4 men arrested for gang raping a lesbian

I just ran across this shocking story on Yahoo News.



It's exceptionally tough for me to be objective in this case, I admit, but I think this story makes a clear case for hate crime laws.



This is also one of those rare cases where I feel my position against the death penalty being challenged.



(And makes me think twice about the stickers on my car.)



There's a lot more I could say here, but I'll hold off and see what you all have to say first.

4 arrested in N. California gang rape of lesbian - Yahoo! News



RICHMOND, Calif. – Two men and two teens have been arrested on suspicion of gang-raping a woman last month in the San Francisco Bay area while allegedly taunting her for being a lesbian, police said Thursday.



Officers arrested Humberto Hernandez Salvador at his Richmond home Wednesday night, Richmond police Lt. Mark Gagan said. The 31-year-old is being held without bail on gang rape, kidnapping and carjacking charges.



Police on Wednesday also arrested a 15-year-old Richmond boy and a 16-year-old Hercules boy, who were being held at a juvenile detention center on similar charges. Their names were not released.



Josue Gonzalez, 21, turned himself in Thursday after police announced they were searching for him. He was wanted on charges of gang rape, kidnapping and carjacking.



Gagan said Gonzalez asked for an attorney when he turned himself in but said nothing about his alleged role in the attack.



"We feel that while these four suspects were at large, a large cross-section of our population felt unsafe," Gagan said. "Now that the fourth one is behind bars, we can all breathe a sigh of relief."



Police would not detail each person's alleged involvement. Tips from local residents led to the arrests.



Detectives say the 28-year-old victim was attacked on Dec. 13 after she got out of her car, which bore a rainbow gay pride sticker. The alleged attackers made comments indicating they knew she was a lesbian, police said.



Authorities have characterized the case as a hate crime. Police said the victim lives openly with a female partner.



The 45-minute attack started when one of the men approached the woman in the street, struck her with a blunt object, ordered her to disrobe and sexually assaulted her with the help of the others, according to detectives.



When the group saw another person approaching, they forced the victim back into her car and took her to a burned-out apartment building. She was raped again inside and outside the vehicle and left naked outside the building while the alleged assailants took her wallet and drove off in her car, police said.

Well, this is clearly tragic, but why are these thugs any different from other rapist thugs? If a young woman had a sorority sticker on her car and the rapist said, "you are in a sorority and all sorority chicks are sluts who deserve to be raped" would that be a hate crime. I think anyone who commits a violent crime deserves to spend a long in prison, their reason for committing it should be largely irrelevant.



I don't believe in the dealth penalty unless it is clearly premeditated murder.

When I was in my late teens a rapist was cruising gay bars in Columbus, Georgia to pick out some of his victims. One night we were partying and a member of our group was grabbed in the parking lot and raped. She escaped with her life because someone else walked up on them and the rapist fled. She was lucky. Of the five victims he was positively linked to, two lived.



That was a number of years ago and maybe it is safer to be a gay woman in the South than it was then. Maybe the machismo, "all she needs is a good fucking", attitude has faded some in the intervening years. But I still bear that case in mind and I don't go out of my way to advertise my gayness -- no rainbow stickers on my car.

I've been keeping up with this story - it's appalling. I'm still anti-death penalty, but can understand forester's rethinking of her position LOL.



Purple Monkey Dishwasher - LOL - if anything will kill a stereotype, you and I will put an end to any idea that all gays think the same way. LOL Other than the position on gay marriage, I haven't agreed with you on a single issue yet LOL.

Well we both are against the dealth penalty when it comes to rape. And I am sure we both agree with my sig line.



Unlike most gay people, hubby and I are planning on being parents, while we are planning on adopting boys, for obvious reasons, I could only imagine what it must be like to have a daughter who is brutally gang raped, for any reason. Why is it worse to rape a girl because she is a lesbian, than any other reason. It is a brutal crime and needs to be punished. People capable of gang rape should never, ever get out of jail.

I believe a hate crime is not against an individual - it's against the entire community that is motivation for the attack. It's not only a crime against the victim, but a threat, a warning, an attack on the entire community and meant to inspire fear.



I raised a son, by the way. One isn't any less afraid of their male children being molested than their female children.

Again, I strongly disagree with you on both points. My babysitter, who was a coworker and friend of my moms, was raped. In court, they made it out like she wasn't as important as other victims because she was a dancer (stripper) and that she was asking for it. This is the same thing except people think the this woman suffered more because she was gay. It shouldn't matter if you are black, white, gay, an heiress, or call girl, rape is rape and it is always terrible and wrong.



I think you can safely stop worrying about a male child being sexually assaulted by the time they are in their teens. However with women there is always the risk of rape or sexual battery.

I'm for the death penalty only is cases of murder. None other. But these guys should get some serious time.

Damn dude, you are impressing the hell out of me. Like you said in the other thread, other than the gay topic, we could be BFF's.
