Prosecute the offender to the furthest extent of the law, no slaves or prisoners taken.

I think the sentence gets reduced on appeal, she might do a few months.
It's a real tough case, but there should be some punishment.
As far as a deterrent effect, how many people are talking other people into suicide?
It's a deterrent to something that isn't really happening (see Voter ID)

The 1st Amendment was intended to protect political opinions contrary to those of the ruling party, ie. one cannot be criminally prosecuted for expressing negative views toward those in power. What most Americans don't comprehend, or don't want to, is that Free Speech is limited in scope. This was made very clear by Justice Holmes in Schenk v. United States, 1919. Holmes used the example of shouting "FIRE!" in a crowded theater, which could potentially cause injury to others. Such irresponsible behavior was never meant to fall within the scope of protected Free Speech.

"The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that the United States Congress has a right to prevent. It is a question of proximity and degree."

In this present case the court had to weigh the risk of harm to a troubled teenage boy against the alleged right of a mean-spirited girl to pressure him in that direction. This is not about protected free speech, but about culpable negligence. The question we should ask if whether someone who deliberately sends a child or a mentally-impaired adult into the street knowing the likelihood that such a person could get hit by a car has some perceived right to "free speech" absent any consequences, or whether the government has a duty to protect people from this kind of fatal coercion. Should yelling "FIRE!" in a theater then be allowed?

Screw deterrence. Justice is what is needed.

Some people consider cyber bullying a crime. Johnny's delicate ego needs protected from all enemies both foreign and domestic.

Ego is the core of the soul and more than many have weak ego's. A person with a weak ego is mentally challenged. Nobody on this forum has a weak ego so we are safe.

edit: I stand corrected, Id is the core of the soul but Ego gets what Id wants. Super-Ego restrains both Id and Ego in normal people.

I tend to think the case we are talking about concerns a young man who had mental problems and , for reasons unknowing, this woman used that as a tool to essentially murder him.
