Friend had a bicycle accident in Toronto ! Planning to file a lawsuit soon !

Hey guys,

Have you ever had any bike accidents? My friend Fred had one last month in Toronto. He was riding back to home after watching a tennis match from Ontario on his bicycle.

I was also following him in my bicycle along with my brother Nick.

Unfortunately, Fred got hit by a car which came in his opposite direction. He got his shoulder bone broken and scratches along with injuries on the back too.

It was clear that the car driver were badly drunken and he showed an extremely aggressive behavior to everyone who gathered on the accident spot.

We are planning to file a lawsuit against the car driver at the earliest. Have you ever had any such previous experiences regarding these kinds of cases?

I fixed a lawyer dealing with bicycle accident cases in Toronto. How long it may take to get the case processed?

Any idea about the compensation that he is eligible to claim? I would like to hear your suggestions as well as comments regarding the case.

Any replies will be highly appreciated.

dunno about Canada. were the police called and a report filed? was the driver's drunkeness and aggressiveness reported by the cop? If not, you've probably got nothing. Did you get his license plate number? his name, etc from his license?

Hire a civil suit attorney immediately. Do not delay. It helps the attorney obtain police reports, insurance reports, medical reports, and interview any possible witnesses. Hire an attorney that specializes in these kinds of cases and is compensated only after he win s your case.

In the US in a case like this the driver is usually raked over the coals. I suspect Canada would be similar. Do it quickly, but I think you could shop for a good attorney, they should be tripping over themselves to take this case.

Hi Tracy! Welcome to the tiny Canadian Club here that includes RNG and myself...and that's about it so far.

And, I live in the somewhat smaller city down the highway of Hamilton (approx 500,000 for any US readers) and I'm also an avid cyclist now who ditched the car and usually use my bike for shopping, getting to and from work and whenever possible on days off- taking the back roads to Niagara Falls (my last hometown I did the highway commute from for almost 20 years.) So, I'm aware of the dangers and risks of trying to bike in our car-oriented cities and most regional roads.

I've honestly never tried to bike in Toronto...I've considered it just too dangerous even if you're watching everything and trying to do everything right!

I hope your friend "Fred" sues the ass off that driver and it should be easy in his case based on your information. Most of the time, drivers get off easy and if they don't run over the victim, they will often deliberately take off assuming the cyclist 'just fell down and will get over it' if they're confident nobody got their description or plate number!

Such an incident happened in front of me at the end of the cycling season last year in late October, when I had just started on my way to the Falls, early on a sunny Sunday afternoon. The artery road in the south end of Hamilton Mountain is very busy and overdeveloped in recent years, but has a clearly marked bike lane. I was coming up to a girl several hundred feet ahead of me on her mountain bike when a pickup truck clipped her..knocking her down and doing minor damage to the bike as the driver got too close on approach to making a righthand turn just ahead. The truck driver clearly seen that he had a collision with a cyclist, since he immediately hit the gas and sped around the corner at the next intersection without slowing down at a red light. But, neither of us got the plate number of more than the briefest description of the truck...which likely had very minor damage that would go unnoticed.

The cyclist was only 17, and on her way to work at a store in a new mall in the east end of town. She suffered a broken collarbone and mostly superficial cuts and scrapes from the accident....and that's one of the reasons why I always have a bar-end mirror on my bikes and check it frequently when I'm in traffic to see where the cars are!

In recent years, it seems drivers are even more careless than during previous years...with all the cellphones and other garbage that people are looking at instead of the road in front of them! So, especially cycling around a bigger city like Toronto, I think you have to be half paranoid to keep yourself safe out on the road on a bike! I know that...when I'm on my long rides to the Falls, I always feel a drop in tension and a sense of relief when I get past Stoney Creek and onto the quiet farm roads I travel most of the way that have very little traffic except for the locals.
