Heckler's Veto and the Sixth Circuit

Thuggery wins, free speech rights lose - The Washington Post

Quote:
The free speech rights here were as in many free speech cases the rights of pretty rude speakers, certainly ones whose message and manners I do not endorse. But the First Amendment protects the rude as well as the polite, especially given how subjective government judgments of rudeness usually end up being.

.......................

The society we live in stems from the incentives we create. Incentives for violent speech suppression mean more violent speech suppression. That, I think, will be the consequence of the Sixth Circuit panel decision, if it is not reversed by the en banc Sixth Circuit or by the Supreme Court.

The first amendment was not created to protect speech we like, it was created to protect those so they can say things that we do not like.

There is no reason to protect speech people like.. because it will not be a point of objection.

This is a very interesting and thought-provoking piece, which should be required reading by all who bandy the phrase "free speech" around as if it were a catch-all fix it phrase.

Thanks for posting.

See: Skokie, IL.
What I agree to is that wasn't free speech, not at that point. That was inciting a riot. The pig's head on a stick shows what these morons were after, and it wasn't a chance to converse peacefully with others in public.

Hecklers are the ones that disrupt the free speech right of others.

This ruling and situation needs to be put in perspective with another state court ruling regarding white students being disciplined for wearing American flag shirts to school on cinco de mayo day and the unconstitutional "hecklers veto."

Here was a response I wrote regarding the other ruling when it came up a few months ago here:

The ruling is not supported by Supreme Court precedent, and should be overturned on 1st Amendment grounds. The court’s panel misapplied the Tinker Rule (Tinker v. Des Moines Indep. Comm. School Dist.), by erroneously designating the American flag wearers as the disruptors, when the Mexican students are the disrupters. Also the ruling violates Supreme Court precedent regarding a “heckler’s veto.” In 1969, Gregory v. Chicago, the court ruled in favor of demonstrators (American flag shirt wearers), over the violent reaction of by-standers (Mexican students). Justice Black called the arrest of the demonstrators rather than the people who reacted as a “heckler’s veto.” Court precedent prevents the acting party’s 1st Amendment right to speech cannot be restricted or silenced to prevent a reaction from another party.

Another reason is the school just rewarded the violent behavior of the Mexican students. What the Mexican students just learned that if they do not like something, all they have to do in the future is threaten violence. They learned that crime and being a thug will be rewarded if the threat of violence is used.
