The first paragraph is not a grant of power. The enumerated powers follow the first paragraph. The neccessary and proper clause limited all powers of congress to only the power to carry out the enumerated powers. There is no historical record that supports your position and all the historical records support my position.

A FDR puppet court has nothing to do with the meaning and intent of the Constitution. The first paragraph of Article I, Section 8 had a specific meaning based on the reason for the Revolutionary War, and you cannot go there.
