And yet that is happening, and not infrequently. I don't supposed the fact that your country has been doing things that way virtually since its inception doesn't factor into your thinking?

In the case of gay marriage, they did not make a law, they ruled that laws forbidding gay marriage were unconstitutional, exactly what they are supposed to do. Whether that should be a state matter rather than federal is also handled by your constitution and amendments.

And they have the ability to decide to interpret the phrase in the 14th to not include illegals. They haven't done that (yet). But till someone or some entity gets it before the SC, that's the way it is.
