Does it violate your right to life?
Does it violate your liberty?
Does it stop your pursuit of happiness?
I am guessing your implying that the hog farm would allow wash off into the creek, thus ending up on your property or your stretch of the creek. Then, your right, pursuit of happiness and probably even a good argument of life would be violated. He would be tainting your property.
Now, if were just talking about the smell of the hogs. I would see where you would think violation of pursuit of happiness. But, it would be wrong. You cant be violated by nature. You could claim it wouldn't happen if his hogs was not on that land. But, you would be violating his pursuit of happiness by telling him he cant have hogs on his own land.
That is how I would see it
