He said that a successful prosecution was virtually impossible, IIRC. So there wasn't enough evidence to indicate she had committed a crime. Not convicted = innocent.

The bit I bolded in your post carries a lot of weight.

That is not the end of it....IF Comey had made such a memo, that would prove he thought that Trump was trying to Obstruct Justice and then Comey would have been obligated to bring that to the DOJ 3 months ago, or be invilation of Federal Statute himself...

The FBI does not "convict" anyone...it gathers evidence and then sends it onto the Attorney General to prosecute or not prosecute... Comey had no business deciding guilt or innocence....what he did was change words in the Statute from "gross negligence" to "intent"....and then claimed no prosecutor would charge her without proving intent.....hmmmmmm??? wasn't that the same word Obama was using just prior to July 5th....

You're starting to sound like Jimmyb about the SC. I'll take their word on the constitution rather than his and I'll take Comey's word on what is prosecutable rather than yours.

And Comey's words are still not backed up with anything.....
