This article is a bit too profound for an average bumpkin like me:
As I understand it the SCOTUS starts by telling Americans they must eat ice cream well-knowing that lawmakers and bureaucrats will quickly tell Americans which flavor of ice cream they must eat. Example: The High Court decriminalized abortion well-knowing that taxpayers must pay for those abortions. That is how judicial activism works in Socialism’s America.
. . . I should note that as used here, the phrase “judicial activism” is the antonym of “originalism,” not the antonym of “judicial restraint.” It doesn’t mean an inclination (rather than a hesitancy) to overrule the actions of elected officials or the decisions of previous courts. Instead, activism means the interpretation of the Constitution, on questions where its original meaning is clear, in a sense deliberately contrary to that meaning so as to obtain a result favored by the judge.
