In law, intent means absolutely nothing, so its futile for people to pretend it matters what the intent was. What matters is what was written and how that is interpreted. In legal contract disputes, you can't later you meant something else if the words in the contract are interpreted to mean another thing. Maybe you didn't intend it, but this is why legal contracts are so long and laywer get paid big bucks to draft them. That's not how law works. That's why we have a history of court cases dealing with constitutional law, just as was put into the constitution

How do the 9th and 10th nullify Article I Sec. 8? Be specific.

I never said they nullify Article I. You keep resorting to straw-men which is a sure sign the argument is getting away from you.

I am saying that the 9th and 10th Amendments come chronologically after the general welfare clause and even Article I. To the extent that anything in the 9th and 10th conflicts with implied or expressed intent in earlier versions of the Constitution we are logically compelled to honor the language of those later amendments.

Let's get to what they actually say (emphasis added):

  • The 9th: The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.

  • The 10th: The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

How on earth could anyone honestly read those words and say an open-ended interpretation of the federal governments powers and authorities exists?

We all know the sentiment out there to repeal the Second Amendment on the Left, but do any of you realize the sentiment to at least partially do away with the First Amendment as well? Many in the poll provided thinks that hate speech should be banned, but what is hate speech? Moreover, who will decide what it is? For example, is calling Trump a "Cheeto" hate speech? Is calling Trump a Dotard hate speech? Is pretending to hold his severed bloody head in your hand hate speech? Is Madonna saying she wants to burn Trump alive in the White House hate speech and should that be banned? If asked this same question, I'm sure most left leaning people would say no, it is OK, but if the same were done to Obama, my guess is the sentiment would swing the other way as it would be viewed as racist. You see, the kind of hate is what is important. Is it a good hate or a bad hate?

When asked if they think hate speech should be against the law, 48 percent said they think it should be against the law, while 31 percent said they think it should “be allowed.” Twenty-one percent of respondents answered with “did not know.” Decades of Left wing influence in education and the media have brought us to this point.

Add to this fact that mass media corporations like Google and Facebook have been accused of censoring speech simply because they may offend other politically on some level.


And then there are "safe zones" at universities across the US that don't allow political speech or ideas that may offend since they run contrary to Left wing ideology

No, that's exactly how law words, and especially contract law. The question of intent is central to what words mean.

For example, when a contract says "payments are due on the last day of the month," does that mean the last working day? The last day even if it's a weekend? Does it mean your payment is late if it arrives after the sun goes down? How do we know "month" is referring to a month on the modern Gregorian Calendar and not the months of the Julian or Inuit calendars?

A reasonable assessment of intent is fundamental to interpreting virtually all law.

Indeed. All you hear is what they want to ban.

The only rights Leftist care about is the rights regarding having sex, abortion, and illicit drug use. Everything else they want to dictate to the rest of the country.

Conversely, conservatives focus on restricting abortion and letting people decide everything else for themselves.

But at the end of the day, power corrupts and since the Left focus' on controlling all aspects of money, they are the natural candidates for power hungry dictators.
Is your goal here to piss of as many on the left-of-center as you can, or to discuss serious issues? If the latter, you've got a hell of a long way to go to get there.

The "Constitution" is The Constitution. And the main enemies of the Constitution today stand well to the right.
